This Privacy Notice describes how E-Myth Worldwide, Inc. (“EMyth” or “we” or “our” or “us”) treats certain information collected or provided in connection with an end user’s (“you” or “your” or “user”) use of EMyth’s website, https://www.emyth.com, and any other website, social media pages, apps, or other digital medium owned or operated by EMyth. This Privacy Notice also applies to any Personal Information (as defined below) collected, stored, or used by us, such as information you provide us through the above mediums, by email, mail, or telephonic communications, or any other way (collectively, the “Site”). Our Site and any and all products and services provided to you by EMyth may be referenced as the “Services”. 

The information provided in this Privacy Notice is designed to inform you of what information we collect, why we collect such information, how we use the information we collect, and the choices we offer, including how to access and update information. By accessing or using our Site, you consent to the Terms and Conditions and this Privacy Notice, including our collection, use, and disclosure of your Personal Information, as described below. This Privacy Notice is not a contract and does not create any legal rights.

Our Collection and Use of Personal Information

Personal Information is any information that can be used to identify you. This Privacy Notice does not cover data we, or our authorized third-party vendors or partners, collect that cannot be used to identify an individual or to pseudonymous data. 

We get most Personal Information directly from you, through the Site, or from transactions with you. We might also obtain Personal Information about you from other Site users or other entities with whom we have contact. For example, we may obtain information through public records, or transactions you have with our authorized third-party vendors or partners, including our affiliates, agents, and/or partners. If you are sharing information with us about any other individual or entity, you must obtain the proper consents first. 

Categories of Personal Information we may collect from you include:

  • Your name.
  • Contact information, such as your phone number, email address and mailing address
  • Payment card number (or other payment method) and related validation information.
  • Information you provide when interacting with the Site, including transaction data and purchase history, and communications (email/DM).
  • Website analytics information, such as when, how often, and for how long you use the Site; information related to your geographic location; the content you submit and view; the name of the domain and host from which you access the Internet; and the IP address of the computer or device you are using.
  • Employment information, such as your profession, occupation, and job title.
  • Other identifiable information about you, such as date of birth, gender, photographic images of you, and age, including for purchases

You can choose to not provide certain information to us, but it may delay or prevent us from providing our products or services to you, including your ability to fully access our Services or participate in any promotions.

We do not currently respond to Do Not Track or Global Privacy Control browser settings. We reserve the right to update our practices and Privacy Notice as such standards evolve.

Our site may have functionality in connection with ChargeOver and Mighty Networks, providing us with certain aspects of the online e-commerce platform that allows us to sell our products to you. Purchaser data is stored through ChargeOver’s or Mighty Network’s data storage, databases, and interfaces. ChargeOver, Stripe and Mighty Networks (or their third-party payment processing vendors) store purchaser data on a secure server behind a firewall. Please note that in such circumstances, we do not ourselves directly process or store the debit/credit card data that purchasers submit. If you choose a direct payment gateway to complete your purchase, then ChargeOver, Stripe or Mighty Networks stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Any purchase payment transaction data on our system is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase payment transaction information is deleted from our system, but said data may be retained by the processor. If you have subscribed, we keep your payment transaction data until after your subscription expires. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. We are not responsible for the Privacy Policy, Cookie Policy, or Data Processing Agreement of ChargeOver, Stripe and Mighty Networks, and you assume all related risks when interacting with their services.

Accounts

For some aspects of our Site, you may need to or be able to register an account with us via our Site (“Account”) by providing certain Personal Information. In doing so, or in connection with our Services generally, you may need to represent, for example, that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use the Site. You may also need to provide a valid email address or add shipping and billing information to place orders. All information that you provide to EMyth or its vendors, agents, associates, or partners, including your payment card or financial account information, is subject to EMyth’s Privacy Notice or the respective third-party privacy notice. You may update, correct, or delete information about you at any time by logging into your Account and updating your profile information or by emailing us at privacy@emyth.com. If you wish to delete your Account or, under appropriate circumstances, any Personal Information that may have been collected, please email us at privacy@emyth.com, but note that we may require further confirmational procedures and necessarily retain certain information about you for legitimate business purposes or as required by law. 

Personal Information Provided from Other Sources

We may collect Personal Information about you from other Site users or other individuals and entities with whom we have contact, including through credit reports or public records. If you are sharing information with us about any other individual, you must obtain their consent.

We may also automatically receive and store certain types of Personal Information whenever you visit the Site, such as information from Google Analytics on when, how often and for how long you use the Site, information related to your geographic location, and the content you submit and view. This information may include the name of the domain and host from which you access the Internet and the IP address of the computer or device you are using. We may log and use your IP address to administer the Site, to help diagnose problems with our server, to analyze trends, to track users’ webpage movements, to help identify you, and to gather broad demographic information for aggregate use. We may use standard tools, such as cookies or web beacons, to monitor the Site and Internet usage and to improve or customize the content on the Site. You can control the use of cookies by changing your browser settings.

Our web servers may collect log data, which provides aggregate information about the number of visits to different pages on the Site. We use such aggregate log data to improve access to the Site based on visitors’ web browsers and operating system types to make the Site available to as many users as possible. We do not link the log data collected to Personal Information. Third party providers may also collect aggregate log data independently from us.

Our Site includes social media features connected with social networking sites such as Facebook, Twitter, and LinkedIn. Those sites may collect your IP address, which page you are visiting on the Site, and may set a cookie to enable social media features to function properly. Your interactions with social media sites, including any Personal Information you provide via buttons or links to these sites are governed by the privacy notice of the social media company. If you sign in through a social media account, you are authorizing us to collect, store, and use any and all information that you agreed the social media company would provide to us through its Application Programming Interface (“API”), such as your name, username, email address, and profile information.

We may collect Personal Information in order to improve our services, to deliver services, to perform contractual obligations, to comply with legal obligations, to help identify and prevent fraud, and for other purposes as described below:

In addition to the purposes listed above, we may also collect and maintain Personal Information about you to create a personal profile containing preferences and other information that you voluntarily provide to us. Examples of the types of information we may collect for this purpose include your first and last name, a valid email address, and geographic location or address. Additionally, we may use your email address to send confirmation of purchases and, if necessary, to contact you to help process a purchase. We may also use your email address to notify you about special offers and promotions that may be of interest to you.

If you make a payment through the Site, a third-party payment processor, ChargeOver or Stripe, will receive your payment information for purposes of processing such transaction. Purchases generally require payment card information to process. This includes name, payment card number, expiration date, billing and/or mailing address, and authentication codes or related information as needed to authorize the charge and complete the transaction. Payment card data transferred in connection with our payment processor is via a Secured Sockets Layer (SSL) line if you are using a SSL enabled browser such as Firefox, Safari, or Google Chrome. This ensures that your Personal Information is encrypted as it travels over the Internet. We do not receive or store complete payment card information, though our payment processor may maintain your information for its records until you ask the payment processor to delete this information.

Our authorized third-party vendors and partners have their own privacy policies. Those policies will govern the use, handling, and disclosure of your Personal Information with those third parties.

Disclosure of Information

In order to conduct our business and better serve you, we may disclose Personal Information and other information about you or your activities on our Site or while using our services with:

  • Our affiliates.
  • Our service providers and vendors, such as payment processors, promotional partners, website hosts, analytics providers, legal counsel, and various customer, tech, and operational support.
  • Third parties approved by you, such as social media sites.
  • Financial and legal institutions.

We do not sell your Personal Information to any third parties.

Categories of Personal Information Disclosed or Sold

We do not sell your Personal Information to any third parties. We do not knowingly collect or sell Personal Information of consumers under the age of sixteen (16). In the preceding twelve (12) months, we did not sell any categories of Personal Information.

In order to conduct our business and better serve you, we may disclose Personal Information and other information about you or your activities on our Site or while using our Services with:

  • Our affiliates.
  • Our service providers and vendors, such as payment processors, promotional partners, website hosts, analytics providers, legal counsel, and various customer, technology, and operational support.

Some third-party providers may independently collect Personal Information when you visit our Site. For example, our Site may include social media features connected with social networking sites or utilize marketing/mailing list services. Those sites may collect your IP address and which page you are visiting on the Site, and may set a cookie to enable social media features to function properly. Our authorized third-party vendors and partners have their own privacy notices which govern the use, handling, and disclosure of your Personal Information. For example, your interactions with social media sites, including any Personal Information you provide via buttons or links to these sites, are governed by the privacy notice of the social media company.

We also may use third-party web analytics services on our Site, such as those of Google Analytics. The information collected may be used by EMyth and/or others in aggregated / anonymized formats to, among other things, evaluate use of the Site and relevant Services, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on our Services and other websites, and better understand your online activity. Legal Basis for Processing Personal Information

We may process Personal Information if one of the following applies: 

  • You have given your consent for one or more specific purposes described in this Privacy Notice.
  • It is necessary for the performance of an agreement with you and/or for any pre-contractual obligations thereof. 
  • It is necessary for compliance with a legal obligation to which you are the subject. 
  • It is related to a task that is carried out in the public interest or in the exercise of official authority vested in EMyth.
  • It is necessary for the purposes of the legitimate interests pursued by EMyth or by a third party.

Our Usage of Cookies

What are cookies?

Retention, Confidentiality, and Security of Personal Information

We store Personal Information for as long as is reasonably necessary to fulfill the purposes described herein, as we determine is necessary for business records, and as required under applicable law.  Specifically, Personal Information collected for purposes related to the performance of a contract between you and EMyth shall be retained until such contract has been fully performed. Personal Information collected for the purposes of the EMyth’s legitimate interests shall be retained as long as needed to fulfill such purposes. 

We restrict access to Personal Information to those who need to know in order to provide services to you and to conduct our internal operations. We maintain reasonable physical, electronic, and procedural safeguards to guard your information. However, the Internet is not absolutely secure and, thus, we cannot promise guaranteed security. In the unlikely event that we believe that the security of your Personal Information in our possession or control may have been compromised, we may seek to notify you. As applicable, we will comply with notification requirements for a security breach and may also notify you by email.

In the event of a merger, acquisition, corporate change, or bankruptcy, we may share or transfer your Personal Information as part of a transfer of our assets to the acquiring entity.

Your Rights Based on the General Data Protection Regulation (GDPR)

You may exercise certain rights regarding your Personal Information processed by us. In particular, you have the right to do the following, to the extent permitted by law:

  • Withdraw your consent at any time—You have the right to withdraw consent where you have previously given your consent to the processing of your Personal Information.
  • Object to processing of your Personal Information—You have the right to object to the processing of your Personal Information if the processing is carried out on a legal basis other than consent. Where Personal Information is processed for a public interest, in the exercise of an official authority vested in EMyth or for the purposes of the legitimate interests pursued by EMyth, you may object to such processing by providing a ground related to your particular situation to justify the objection. You must know that, however, should your Personal Data be processed for direct marketing purposes, you can object to this processing at any time, free of charge and without providing any justification. Where you object to processing for direct marketing purposes, the Personal Information will no longer be processed for such purposes.   • Access your Personal Information—You have the right to learn if Personal Information is being processed by EMyth, obtain disclosure regarding certain aspects of the processing and obtain a copy of the Personal Information undergoing processing.
  • Verify and seek rectification—You have the right to verify the accuracy of your Personal Information and ask for it to be updated or corrected.
  • Restrict the processing of your Personal Information—You have the right to restrict the processing of your Personal Information. In this case, EMyth will not process your personal information for any purpose other than storing it.
  • Have your Personal Information deleted or otherwise removed. You have the right to obtain the erasure of your Personal Information from EMyth.
  • Receive your Personal Information and have it transferred to another controller. You have the right to receive your Personal Information in a structured, commonly used and machine readable format and, if technically feasible, to have it transmitted to another controller without any hindrance.
  • Lodge a complaint. You have the right to bring a claim before competent data protection authority.

You are also entitled to learn about the legal basis for Personal Information transfers abroad including to any international organization governed by public international law or set up by two or more countries, such as the UN, and about the security measures taken by the Owner to safeguard their Data.

How to Exercise Your Rights

Any requests to exercise your rights can be directed to EMyth through the contact details provided in this document. Such requests are free of charge and will be answered by EMyth as early as possible and always within one month, providing you with the information required by law. Any rectification or erasure of Personal Information or restriction of processing will be communicated by EMyth to each recipient, if any, to whom the Personal Information has been disclosed unless this proves impossible or involves disproportionate effort. At your request, EMyth will inform them about those recipients.

Residents of Nevada

Relevant consumers may submit a verified request directing EMyth to not make any sale of any covered information EMyth has collected or will collect about the consumer by using the following information: privacy@emyth.com or 1467 Siskiyou Blvd #2071, Ashland Oregon, 97520. You or your agent must provide sufficient confirmable and/or identifying information in order for us to verify and process your request.

International Transfer of Personal Information

EMyth is headquartered in the U.S. In addition, our Site is hosted in the U.S. and the information we collect is governed by U.S. law. However, our Site may be accessed by international visitors. If you are located outside of the U.S. and you are accessing the Site from outside of the U.S., please be aware that information collected through the Site may be transferred to, processed, stored, and used in the U.S. and other jurisdictions, and made accessible by our affiliates and our third party services providers (e.g. our third-party service providers that collects your contact information to assist us with fulfilling our services). Data protection laws in the U.S. and other jurisdictions may be different from those of your country of residence. Your use of the Site or provision of any information therefore constitutes your consent to the transfer to and from, processing, usage, sharing, and storage of your personal information about you in the U.S. and other jurisdictions as set out in this policy.

Under certain circumstances, you may have the following rights:

  • The right to request access to your Personal Information in our possession.
  • The right to request rectification (correction of inaccuracies) of your Personal Information in our possession.
  • The right to erasure (deletion) or of certain restriction of processing of your Personal Information in our possession.

  • In the future, if we process any of your Personal Information by automated means, you may have the right to data portability (transfer) of your Personal Information in our possession.

Where you have given us consent to process your Personal Information for a specific purpose, you may withdraw that consent for processing that has not yet occurred.

Children Under 13

We do not knowingly collect information from minors and the Site is intended for adults over the age of 18. If you are a parent or guardian and believe that your child under the age of 13 has provided Personal Information to us without your consent, please notify us at privacy@emyth.com. If we become aware that information is or has been submitted by or collected from a minor under the age of 13, we will work to promptly delete this information.

Viewing and Amending Information

If you no longer wish to receive communications from EMyth, please contact us at privacy@emyth.com.  Opt-out requests may not be able to be immediately processed and we may continue to send you other types of transactional email communications.

Users may log into the member site to view, amend, or delete account information. Please note that while changes or deletions to your account or Personal Information may be reflected promptly in the active user database, our servers or our associated third parties may retain previously provided information, and may be required to keep certain information or not delete it, or keep information for a certain period of time.

Any changes to, or deletion of, account information does not affect any other information collected by us, or which we may retain and continue to use or disclose in accordance with this Privacy Notice. If we already provided your Personal Information to a third party before you changed your preferences or updated your account, you may need to change your preferences directly with that third party.

We reserve the right to verify the identity of any person making a request to opt-out or to delete or modify Personal Information; provided, however, that we will have no liability of any kind resulting from false or erroneous requests or any change or deletion made by us for any reason.
